MID LAKE CAMPGROUND

By visiting Mid Lake Campground located at 3636 Palo Gaucho Crossing, Hemphill, Sabine County, Texas 75948 (the “Premises”) you, the “User,” agree to the following terms and conditions.

I agree, and shall cause my children, invitees and guests, to abide by the Park Rules, including those rules and policies published by Mid Lake Campground, LLC or its agents (“Campground”) at www.midlakecampgroundtx.com, posted at the Premises, or otherwise communicated in any manner for the use and occupancy of the Premises.

This agreement does not constitute a landlord/tenant agreement. Payment for sites is entirely for services rendered UNDER A HOST / GUEST ARRANGEMENT.

CREDIT CARD POLICY

I understand that Campground will keep my credit card information on file. The credit card information will be used by Campground in the event that Campground must charge for cleaning or repairing the Premises or if I vacate the Premises without paying the total amount due. If Campground uses the credit card information for the reasons described above, Campground will provide User a statement of account listing the charges.

CHECK IN/OUT PROCEDURES

If you Checked In Online you may proceed directly to your site. All others, Check In at the convenience store upon arrival. Call ahead for early check in availability.
• RV Check in: 1 PM CST and Check Out is at 11 AM CST.
• House and cabin Check in: 3:00 PM CST and Check Out is at 11 AM CST

CANCELLATION POLICY

RV sites 

8 days and over:  100% refund minus 10% cancellation fee

7 days and under : 50% of reservation forfeited

House and Cabin  (non-holiday)

15 days and over:  100% refund minus 10% cancellation fee

14 days to 4 days: 50% of reservation forfeited

3 days and under: 100% of reservation forfeited

House and Cabin  (holiday – Memorial Day, July 4th, Labor Day)

30 days and over:  100% refund minus 10% cancellation fee

29 days to 8 days: 50% of reservation forfeited

7 days and under: 100% of reservation forfeited

 

No Show Policy:
Reservations will be held until check-out time on the day following your scheduled arrival. No shows will result in full forfeiture of funds.

Refund Policy:

Refunds are prohibited for weather conditions, voluntary departure, acts of nature, and evictions.  Any refund processed will be refunded in the same form that it was originally paid.  All refunds processed via credit/debit card will be processed back to the original credit/debit card used at booking, No exceptions.

The cancellation policy shall be amended in the event a natural disaster (hurricane, tropical storm/warning) is issued for the camp area within 48 hours of the reservation arrival date or when there is a mandatory evacuation of the area and the campground will be closed.

TERMINATION POLICY

Campground’s Right to Terminate. I acknowledge that Campground may terminate any agreements for any and no reason by providing me a notice to leave the Premises (“Termination Notice”). The notice shall not be required if termination is the result of an Act of Default (as defined below).

The Premises is privately owned and Campground RESERVES THE RIGHT TO REFUSE SERVICE to, or terminate agreements, with anyone for any reason except for those prohibited by law. Campground reserves the right to require any person or party it deems necessary, to leave the Premises based on violations of Park Rules or behavior management deems inappropriate, disturbing to others or an Act of Default.  Harassment or mistreatment of our staff or other guests, including but not limited to, racist comments or hate speech, will not be tolerated under any circumstances.

Default by User. The following acts constitute defaults by User (“Act of Default”):

  1. Failing to timely pay the rate agreed on or other lawful charges when due;
  2. Giving false information to Campground;
  3. User, User’s guests and/or occupants failing to comply with Park Rules, such as violating provisions of the terms and conditions or committing serious misconduct or criminal acts; and/or
  4. Remaining on the Premises after being asked to leave.

Evacuation. Campground reserves the right to require User to evacuate the Premises in the event of an emergency or catastrophe, as determined by Campground, or as Campground otherwise determines is necessary for the protection and/or safety of User and/or any other person(s). When notified of any such evacuation by Campground, User hereby agrees to, and to cause User’s guests, invitees and occupants to, immediately evacuate from the Premises and/or Campground’s property, as required by Campground, and remain a safe distance from the affected area until Campground notifies User that no further hazards are present and that User is permitted to return.

CAMPGROUND SHALL NOT BE LIABLE TO USER FOR ANY COSTS OR EXPENSES SUSTAINED OR INCURRED BY USER IN THE EXERCISE BY CAMPGROUND OF ITS RIGHTS IN THIS PARAGRAPH AND USER HEREBY WAIVES ANY AND ALL CLAIMS AND/OR CAUSES OF ACTION AGAINST CAMPGROUND FOR DAMAGES BY REASON OF INTERRUPTION OF USER’S USE OF THE PREMISES BECAUSE OF THE EXERCISE BY CAMPGROUND OF ITS RIGHTS IN THIS PARAGRAPH.

RELEASE, WAIVER, AND INDEMNITY

I HEREBY RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE Campground from any and all liability to me, my children, my invitees/guests, personal representatives, and heirs for any loss or damage on account of injury to person (including death) or loss or damage to property relating to, or arising out of, use and occupancy of the Premises and any dangers and hazards associated with acts of nature such as changing weather conditions; high winds; thunder and lightning; temperature fluctuations; falling trees; tree limbs, ice; or encounters with wildlife.

I HEREBY AGREE TO INDEMNIFY, SAVE AND HOLD HARMLESS Campground from any loss, liability, damage or cost (including attorney fees) they may incur due to injury (including death), damage or loss of property relating to use of the Premises by me, my children, and/or my invitees/guests or due to any incidents that may occur during my stay. I understand that, although Campground makes every reasonable effort to provide a secure environment, the security of my person, my belongings, and all persons registered in my party is my sole responsibility.

As a courtesy, our employees, if so requested, may assist with directing you to your designated campsite. It is your sole responsibility to ensure that the site will accommodate your specific trailer/RV and that you will not hit any branches, bollards, trees, etc. when positioning your RV on the campsite. You agree to indemnify and hold Campground harmless from any loss, liability, damage or cost (including attorney’s fees) that may result from an employee assisting or directing you onto a campsite. Furthermore, you release, waive, discharge and covenant not to sue Campground for any and all liability, loss, or property damage relating to an employee assisting/directing you to your site.

ADDITIONAL TERMS FOR RENTAL UNITS (CABIN 5 & ANGLERS COVE HOUSE)

I understand and agree as follows:

At departure, the rental unit is to be left in a reasonably clean condition (broom swept), garbage is to be removed from the rental unit and placed in an outside trash can/dumpster, In the cabin, all dishes are to be washed and put away in the cabinets.  In Anglers Cove house, place dishes in the dishwasher and start.  The microwave, fridge, stove and countertops are to be wiped clean; otherwise, Campground may charge my credit card with a cleaning fee.  I understand and agree that if I leave the rental unit in an unclean condition or smoke in a rental unit, Campground may charge my credit card for the cost to clean the rental unit ($_35__ minimum charge).

All damages to the rental unit, whether caused by myself, my children, guests or pets, will be disclosed to the registration office immediately or at checkout. All damages occurring to the rental unit during my stay will be charged to my credit card after a thorough inspection has been made by Campground. Damages for which I will be responsible include, but are not limited to: lost key(s), broken/lost TV/DVD/AC remote controls, broken items, discharged fire extinguishers (if not used for a fire), damaged/dented/bent appliances, furniture, cabinetry or dishes, writing on walls or bedding, and ripped or torn mattresses or covers.

ANIMAL POLICY AND WAIVER

I hereby agree to the following regulations and conditions relating to my pet while camping at Campground with my pet.

Excluded Pets. I agree that the Campground has the sole discretion to exclude certain breed of dogs and other exotic pets. The basis for exclusion of dogs may include, but is not limited to the following: breed-specific exclusions; due to their young age are exempted from state or local law vaccination requirements; are sick; are in heat; are aggressive, vicious, dangerous or potentially dangerous; require muzzling; or are easily frightened or sensitive, resulting in disruptive behavior (such as fighting or biting) in response to a stimulus.

Supervision. I agree to keep my dog on a leash or in a carrier while in all public areas of the Campground. I further agree to have my dog with me or a designated individual at all times, and understand that I must kennel my dog when left unattended in the cabin, or house. I agree to prevent noise or any other disturbance by my dog, in the interest of other guests at the Campground.

Vaccinations. I represent and warrant that my pet is up to date on all vaccinations (including rabies and distemper) and flea treatments.

Disturbances. I agree that, should my pet create any disturbances, which causes complaints to be made to the management by other guests or employees of the Campground, at the request of a Campground employee, I will immediately make arrangements to house my pet elsewhere outside the Campground. Additionally, I understand and agree that if I do not find alternative housing for my pet after being asked to do so, I will be asked to leave the Campground and will not be issued a refund.

Assumption of Risk and Release. I understand that my permission to have my pet at the Campground with me is a privilege and not a contractual right. Such permission is expressly conditional upon my adherence to the terms of these rules and other rules in effect at any given time. I understand that the Campground may revoke such permission at any time for any reason. Additionally, I hereby assume all responsibility of risks, injury, damage, other harm that may occur while my pet is at the Campground or caused by my pet. Further, I hereby knowingly and voluntarily expressly release and discharge the Campground, its owner, its agents, its parent companies, members, managers, directors, officers and employees (“Released Parties”) from any and all claims, damages, liabilities, injuries, demands, or causes of action, both present and future, whether known, unknown, anticipated or unanticipated, that me or my guests or invitees may have against any of the Released Parties arising out of or incident to my dog’s presence in the Campground, whether arising from any act or omission, whether negligent or otherwise, of me, my pet and/or any guest or invitee. I further agree to indemnify each of the Released Parties for any and all such claims, damages, liabilities, injuries, demands, or causes of action, including costs, expenses, and attorney’s fees arising as a result of or related to the presence of the pet at the Campground. This provision shall be enforceable to the fullest extent of the law.

Acknowledgment. By signing below, I acknowledge that I have read the foregoing Assumption of Risk & Release and fully understand its provisions and implications. My execution of this Release is entirely voluntary and intended to be binding on my heirs, executors, legal representatives and assigns.

I have read this Animal Waiver and understand it is my responsibility to abide by the Rules. I further understand that it is my responsibility to ensure that my guests and invitees also comply with the Rules. Failure to adhere to the policies and rules set forth herein may result in my removal from the Campground without a refund.

SEPTIC RULES

COVID

In light of the global pandemic associated with COVID-19, everyone shares in the obligation to observe certain requirements and guidelines to help keep themselves and others safe within your shared community.  In particular, I represent that I have not tested positive for COVID-19 within the last two (2) weeks and I have not been in direct personal contact with someone who has tested positive for COVID-19 within the last two weeks either.  If I do test positive for COVID-19 or come into contact with someone who has, or if my temperature exceeds 100 degrees Fahrenheit and I experience other COVID-19-related symptoms, I agree that I will not seek to enter the resort/community until I am no longer symptomatic for five (5) consecutive days.  I agree to observe the safety requirements within the resort/community spaces — including wearing a personal mask when required, and observing required routes of circulation, occupancy limitations, social distancing and sanitization requirements.

Acknowledgement

 I have read these terms and conditions and agree to it as well as all Campground Park Rules and regulations. In addition, I understand that I am responsible for the actions of all persons registered in my party, including any children, and any guests that visit during my stay.
